Exporter Terms of Service

Effective Date: February 1, 2025

These Exporter Terms of Service (“Terms”) govern the use of PHX Source by exporters who register and list their businesses on our platform. By signing up for our services, you agree to comply with these Terms in addition to the General Terms of Service.

  1. Eligibility and Registration

To list your business on PHX Source, you must:

  • Be a legally registered business engaged in exporting goods or services.
  • Provide accurate and up-to-date company information.
  • Designate an authorized representative for account management.

We reserve the right to verify information and approve or reject registrations at our discretion.

 

  1. Responsibilities of Exporters

By listing on PHX Source, you agree to:

  • Maintain accurate and updated company details.
  • Respond promptly to buyer inquiries and maintain professionalism.
  • Ensure compliance with all applicable export laws and regulations.
  • Grant PHX Source permission to display your business information as per your selected privacy settings.

 

  1. Data Use and Privacy
  • Your information will be published on our directory as per your preferences.
  • You acknowledge and agree to the General Privacy Agreement, which outlines how we handle and protect your data.
  • You may update, modify, or request removal of your listing at any time.

 

  1. Service Fees and Subscription Plans

PHX Source offers both free and premium listing options. If you subscribe to a paid plan:

  • Fees must be paid as per the agreed terms.
  • Non-payment may result in suspension or downgrade of services.
  • Subscription fees are non-refundable unless otherwise stated.

 

  1. Content Guidelines

You are responsible for the content you publish, including company details, product descriptions, and images. You agree not to:

  • Post false or misleading information.
  • Upload content that infringes on intellectual property rights.
  • Engage in spam, fraudulent activities, or unethical business practices.

PHX Source reserves the right to remove content that violates these guidelines.

 

  1. Disclaimer of Warranties

PHX Source provides its platform “as is” and does not guarantee:

  • Buyer engagement or sales results.
  • Continuous, uninterrupted access to the platform.
  • Accuracy of third-party information or buyer credentials.

 

  1. Limitation of Liability

PHX Source shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use of our services, except as required by law.

 

  1. Termination of Services

PHX Source may suspend or terminate an exporter’s account if:

  • The exporter violates these Terms or any applicable laws.
  • The exporter engages in fraudulent, misleading, or unethical practices.
  • The service is discontinued for operational reasons.

Exporters may also request account closure by contacting our support team.

 

  1. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Philippines. Any disputes shall be resolved in the appropriate courts of the Philippines.

 

  1. Changes to These Terms

PHX Source may update these Terms as needed. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
